“Unconstitutional on its face”
Oakland won’t enforce “bubble ordinance” after pro-lifer challenges law in federal court
Just two days after the Oakland City Council adopted a so-called “bubble ordinance” that would have kept pro-life sidewalk counselors at least eight feet away from clients outside abortion clinics, the city has agreed, at least temporarily, not to enforce the new law.
The city’s sudden turnabout came as the result of a lawsuit filed Dec. 19 in U.S. District Court on behalf of a Berkeley man by Life Legal Defense Foundation, the day after the city council approved the ordinance. The lawsuit alleges the “bubble ordinance” violates the First Amendment to the U.S. Constitution, which, among other things, guarantees freedom of speech.
On Thursday, Dec. 20, the City of Oakland agreed to hold off on enforcement of the law during a telephonic hearing before U.S. District Judge Charles Breyer, Christian Newswire reported.
The lawsuit was filed on behalf of Walter B. Hoye II, executive elder of the Progressive Missionary Baptist Church of Berkeley. For the last two years, Hoye has regularly engaged in pro-life sidewalk counseling at the Family Planning Specialists abortion clinic in Oakland. Two women from his church, both over 80 years old, often join him outside the clinic. “We are not a threat to public safety and these women aren't even capable of harassing clinic clients," Hoye told the Oakland City Council during public hearings on the ordinance.
Hoye told California Catholic Daily in an October interview that it is pro-lifers who are harassed, bullied and physically attacked by “escorts” hired by the abortion clinics. “We are supposed to share the sidewalks, but I myself have been pushed and shoved,” Hoye said. “If they are on the left, I go to the right. If they want to walk ahead of me, I let them.”
Hoye said the escorts are so aggressive that some pro-lifers fear for their safety. “I have witnessed them stalking,” he said. “They will follow you to your car and write down your license plate number. One lady that I work with had to take refuge in a coffee shop because they kept following her, trying to find her car. She was afraid to go back to her car. They jumped in their car and followed her to her car, then blocked her, preventing her from pulling out.”
Abortion clinic escorts have subjected elderly women who join Hoye to the same aggressive behavior. “I saw them push an 89-year-old lady! They also pushed an 80-year-old woman I work with,” he said. “The 89-year-old lady stands on the edge of the curb on the sidewalk and says softly, ‘Abortion stops a beating heart.’ That’s all she does. And do you know what they do? They stand on both sides of her, shouting ‘La, la, la, la, la!’ as loud as they can.”
According to a news release from Life Legal Defense Foundation, Hoye’s lawsuit alleges the ordinance is “a content- and viewpoint-based restriction of speech and is unconstitutional on its face.” The lawsuit asks that the federal court enjoin enforcement of the ordinance for those reasons.
The challenged ordinance makes it unlawful, and punishable by up to one year in jail, to knowingly approach within eight feet of any person seeking to enter an abortion clinic, without their consent, to counsel or distribute literature to them or to urge them not to obtain an abortion, the news release said.
“Rather than helping women, this ordinance prevents them from receiving valuable information about their developing baby and options which would let that baby live,” said a statement from Bay area attorney Mike Millen, who joined Life Legal Defense Foundation in filing the suit. “It is sad that city leaders are spending time and money on laws that maximize revenue for the abortion industry at the expense of the health of women and babies."

I think if a survey were done asking "Which religion is the most maladjusted sexually?" Catholicism would be right up there at the top with maybe Islam and FLDS. 82% of Catholic couples of child-bearing age use contraception, but the Church says how evil this. And 80- and 89-year-old women protest against abortion, when, one might assume, they are long past the time when they engaged in sexual relations. And our own JLS will blithely tell other guys to become celibate for the rest of their lives, and one can only think that JLS must have an extremely low sex drive, to even consider such a suggestion. One great misunderstanding that is mentioned here continually, in one form or another, is that sex is S!E!X!, that it is a nasty, filthy, disreputable act, and it is almost never recognized for what it truly can be: a sensuous blending of beings and bodies of two people who are deeply love. When people quote the number of STDs, or talk about abortions, or happily quote condom failure rates, etc., etc., etc., I often get the strong impression that they get their most pleasure from knowing that they are secretly sabotaging sexual relations with their devious and duplicitous statements.

This story concerns abortion, not sex. To oppose the killing of unborn life is not to oppose sex. Further, to oppose the misuse of sex is not to oppose sex, anymore than opposing gluttony is the same as opposing eating. Perhaps you should begin thinking about something else than sex -- then you might realize that there are other things in life that can make celibacy quite possible.

I wrote to every single member of that council. Only one replied to say that she was "praying for me."
We absolutely must stand up to the bullies who push 80 year old women. We must stand up against the harassment as they attempt to take prolife free speech rights from us! For too long these bullies have pushed the envelope as we turned the other cheek and watched our rights erode.
We have the right to speak out against any person or institution that seeks to take the life of an innocent unborn child. Anyone who does not believe these stories of harassment has never personally stood for life on a sidewalk outside an abortion clinic. The stories told are completely in character with my own experiences. I have watched an ob/gyn prolife gynecologist get physically hurled into the gutter by these "caring feminist guards." I have had my skirt lifted above my head as I stood hundreds of feet from the entrance to an abortion clinic. I have had paint hurled at my prolife signs. My friends have been shot in the head with pellet guns. I have been choked around the neck by burly types seeking to discourage me. I have watched these deathscorts chase a male colleague thousands of feet away from the clinic taking photographs and harassing him. We are subject to blaring boombox music and had fences errected so that clients could not see us praying outside the clinic. Enough is enough. It has got to stop. We are there for the babies and their mothers and their families and their futures. Stop it, Oakland. Stop it right now.

Margie, we not only have the right, but have been given the obligation by God. They are not "caring feminist guards", but demonic rabble. I carried a prolife sign alone among 250,000 of these devil's diciples at their first pro-abortion rally in Washington DC ... The thousands of eyes I looked into were denatured souls lusting for death, yet somehow deluded that it is life. There were a dozen of us but spread way out. It was obviously safer in that mega-rally, than at some particular abortion mills. I wouldn't turn the other cheek, and I wouldn't lose the fight; that's why I am not suited for that activity. God showers abundant blessings and graces on those who do the holy work you do.

This is a wonderful Xmas present to everybody in pro-life. As I wrote earlier, I believe bubble laws have been struck down in other jurisdictions, why not here? I am so glad to see LLDF get into the picture, they have vast experience in the matter. In passing this repugnant ordinance, the pathetic members of the Oakland City Council, clearly violated,their oath to uphold the U.S. and California Constitutions, perverting the authority of city government to the exclusion of the rights of others. God bless Rev. Hoye, the Oakland pro-lifers, and the LLDF.

I have had the same experience, being harrassed by "deathscorts". But the worst thing they do is prevent us from giving women the other side of the issue. These "liberals" are fascists who hate free speech, and the free exchange of ideas.

Kudos to the pro-lifers in Oakland. Be strong, be peaceful, and never back down to the pro-abort bullies. In Rochester, NY, we use whatever peaceful, legal means we can to protect our rights as pro-lifers on the sidewalks. They've sued us, harrassed us, even threatened us, but we keep coming back and we are winning. We call the police and report anything illegal that they try to do to us and we have good lawyers to back us up. We know the law and our rights and we are winning hearts and souls one at a time. With prayer and public witness, we've seen many miracles. We remind the "deathscorts" that if they were really for choice, they would make sure every woman going into Planned Parenthood would first have the opportunity to take our pro-life information so that she could have enough information to make a real choice. Keep up the good work and never back down to the pro-deathers.
