Rev. Walter Hoye’s legal woes continue
News from the Trenches
(California Catholic Daily received the following email on June 10 from Rev. Walter Hoye, the Baptist minister jailed for his pro-life witness outside an Oakland abortion clinic. Apparently not satisfied with Rev. Hoye’s jail time and fine, the Alameda District Attorney is now seeking a court order to keep the minister from coming within the length of a football field of Family Planning Specialist Medical Group in Oakland.)
Yesterday, the Alameda County District Attorney (Thomas J. Orloff) filed a "Motion for Injunctive Relief Pursuant to Oakland Municipal Code Section 8.52.040.”
The matter is set for Friday, June 19th, 2009, at 2:00 P.M. in front of Judge Stuart Hing.
This is the latest attack from the City of Oakland.
The D.A. is asking Judge Hing to issue an order to keep me from approaching within 100 yards of the Family Planning Specialist Medical Group's Oakland clinic for a period of three years.
I will be represented by the Life Legal Defense Foundation.

Rev. Hoye, have your attorneys review bringing a "Bivens" type suit against the County Attorney personally. This would be based on the use of knowingly unconstitutional law to inhibit the exercise of your constitutional rights. Seek damages. Good luck. You are a generous man filled with God's Holy Spirit.

The truth is that Pastor Hoye has done nothing to warrent this judicial abuse from the DA's office. He was convicted at his trial of violating an unjust law, in spite of the evidence that exonerated him, and served time in jail unjustly. Judge HIng knows that this is a righteous man, as witnessed by his behaviour during and after his trial. I suspect that if Hing refuses to issue the order, the DA will simply find an activist, secularist judge to do the Enemy's work for him -- and I am under no illusions that this is the work of Satan, as is everything that deals with the 'culture of death'. And anything that deals with ANY crime against humanity ties into the culture of death, and the work ot the Enemy. This contrasts with the Culture of Life, so eloquently described by our late Pope John Paul. Taken to its logical conclusion, the Culture of Life ties into everything good -- life, charity, decency, love of God.

Walter Hoye is one of the kindest and most gentle individuals I have had the pleasure to meet. Where is the threat? What is in the mind of the DA? Pass this unjust restraining order and I and 100 others will take his place on the sidewalk!

I have met Rev Hoye and his wonderful wife in Sacramento. They are peaceful, prayerful people of God. Therefore, let us pray that his enemies find peace rather than a courtroom.

Part of the work of Christ is to bear witness to judges. While these judges are paid money for their time, the witnesses such as Rev Hoye are paid in grace, which is hard to buy food with.

Ron: I had the same impression of Pastor Hoye when I met him.This man of God is the light that is so disturbing to the darkness that manifests itself in Oakland. The war is spiritual in nature. Prayer and devotion are the weapons on this battlefield and the victor is Christ Jesus.

Prayer, and fasting, that is what is called for in this instance. We already know that Jesus will win, in the long run, and in the final battle. He already has, but in this skirmish with the darkness and the pit, we all must put on that holy armour called for. The reverend loves the Catholic Church. Let us all show our love for him and love him back, in the way that is called for in scripture. Pray and fast for this situation to be resolved according to God's most Holy Will. And a few thousand supporters outside that clinic would not be a bad idea. If they make him stay the 100 yards, there should be a "love chain" of supporters strung out along the way leading to their door. Everyone can't be arrested and charged in the same way without someone looking at that and saying "huh!?"

How does the DA have the time to harrass this gentle man when there are countless unsolved murders in Oakland! Why aren't they worried about violent crime? Why aren't the people screaming about the waste of time and money? I'm sure that this nonsense has cost the taxpayers over $100,000 and because of failed prosecutions, allowed many violent criminals to go free in the process! At what point is common sense going to return to Oakland? Has the liberal press addressed this aspect of the case?
The only REAL violence with this case is going on INSIDE of the abortion clinic!

Life Lady: When I met with Walter I tried to buy him something to eat. Walter told me he was fasting. He also told me the Catholic had it right when it came to fasting and prayer.

I'm overcome with admiration for the Rev. Hoye; he has more things Catholic about him than most Catholics I'm familiar with. Hopefully he'll in time find his way into the Catholic Church. He's the kind of person who'd light a fire (of the Holy Spirit) under contemporary Catholicism, & once again, put most of them, including me, to shame. And America needs 10,000 Walter Hoyes to put us on the right track, really living what we say we believe, &, hopefully, flooding the streets in front of the "killing clinics" of so-called choice with witnesses for life.
It seems to me that when the pastors & their assistant priests, and the deacons and the Eucharistic ministers of so many of the southland parishes, all of them, become a weekly presence at the American Holocaust centers, planned parenthood & their cohorts, we will THEN see the beginning of the end of legalized abortion murder; And I mean Catholic people FLOODING the streets, and joined by their Bishops and Cardinals, a HUGE crowd, giving the lie to the spinners so extant today, that women are merely exercising their CHOICE. OF COURSE, JOINED WITH MANY OFFERING PRAYER & SACRIFICE, FASTING, etc., this could & would turn the tide for preborn human life. Let's all make it HAPPEN -- GOD BLESS ALL, MARKRITE

Just think, markrite, if powerful Christians such as Rev Hoye were to enter the Catholic Church what they would do with the additional spiritual resources not presently available to them. Maybe one day the Spirit will move on such waters and the potent Protestant ministers will enter Mother Church imbibe of Her so often untapped power and take it to the world as it is meant to be taken.

The problem, markrite, I fear is that too many Catholic women and other Catholics have had an abortion or taken part in an abortion and have not repented of it. That might be why they keep voting for or are pro-abortion politicians. Something is wrong.

Rev. Hoye is the example of what we are all called to do in defense of God's precious infants. We must JOIN him in prayer and FASTING! As Rev. Hoye knows, many are cast out only by prayer & FASTING!! Now is the time to stand in unison with this holy, humble man of God for all the pre-born. Please pass the word.... especially among all your Catholic friends & clergy: Come out and pray (publicly) WITH HIM!! May Our Divine Savior and His Blessed Mother bless & protect you, Rev. Hoye!!

As Anne T. says, there is only one remedy for sin and that is the Sacrament of Confession. Without that one is at the peril of human nature not to say the least. Human nature has to account for its sin, and short of Confession, can only disguise it while its effects do the further damage.

God bless your hard work Rev. Hoye and may the Holy Spirit keep guiding you. Pope Benedict XVI said that we Christians aren't called for comfort but for higher things. I'm a Brazilian Catholic writing from Melbourne, Australia and praying for you. It's a great pitty that so many of us Christians are divided over fiddlesticks when we all have the very same Core and the same ideals - lets the great battle for life be a mark of our unity! Abortion is a crime!

Walter Hoye has a lot of friends and admirers here in CA and throughout the states. He is soft spoken, very obedient to God and no wonder we love him.

The Pro-life movement has been one of the true ecumenical movements in the world today. We work close in hand with people of all Faiths and some none who are dedicated saving the innocent unborn lives. Yes, we have had many conversons because of this. I have personally witnessed many of them. Norma McCorvy(Jane Roe), Randall Terry, Dr. Bernard Nathanson, are just three of the many.
