“Judge, this is unjust!”

Pro-life pastor gets jail term, fine for violating ‘bubble ordinance’ outside Oakland abortion clinic


In a courtroom jammed to capacity with spectators, a judge yesterday sentenced a Baptist pastor from Berkeley to 30 days in jail, fined him $1,130 and placed him on probation for three years for violating Oakland’s restrictive ‘bubble law,’ crafted to keep pro-life sidewalk counselors away from women entering abortion centers.

Observers said as many as 150 people were outside the courtroom, which seats only about 60, before the 1:30 p.m. hearing began. Some of the standing-room-only crowd were there to support the embattled pro-lifer, while others showed up to back the abortion clinic.

Alameda Superior Court Judge Stuart Hing sentenced the Rev. Walter Hoye amidst what one attorney close to the case called “total chaos, procedurally speaking” after Hoye refused to accept as a condition of probation an order that he stay away from the Oakland abortion clinic where he was arrested. Hing said Rev. Hoye could serve his jail time “by alternative means,” which defense attorney Dana Cody said would “likely mean some kind of community service.”

When Hing adjourned the hearing, an unidentified minister in the courtroom stood up and yelled, “Judge, this is unjust!” At one point, bailiffs tried to handcuff the minister, but later allowed him to leave the courtroom without further incident, witnesses said.

Cody said Hoye has the right to reject “an onerous condition of probation” – in this case a requirement that he stay away from the clinic, which she said was a violation of Hoye’s free speech rights. All parties are scheduled to return to Hing’s courtroom next month to resolve the probation question.

Hoye could have been sentenced to as many as two years in jail and a $4000 fine following his Jan. 15 conviction on two counts of “unlawful approach” in violation of Oakland’s ‘bubble law.’ His attorneys said at the time they plan to appeal the verdict.

Before the sentencing, attorneys for Life Legal Defense Foundation, which represented Hoye, asked Hing to grant a motion for a new trial, saying that the judge erred in failing to give a “unanimity instruction” -- an instruction to the jury that they must agree unanimously on one incident for each count. Instead, jurors were presented with dozens of incidents from which to choose. That, argued Hoye’s lawyers, violated his rights to due process since the jury was not required to agree on which particular act committed by Hoye constituted a crime. Hing denied the motion and proceeded with the sentencing.

Hoye had initially been charged with four counts of violating the ordinance – two counts of “unlawful approach” and two counts of using “force, threat of force or physical obstruction” against ‘escorts’ at Family Planning Specialists Clinic in Oakland. The charges stemmed from two separate incidents – one on April 29, 2008 and one on May 13, 2008. Hoye was arrested on May 13 after a clinic staff member called police. He was carrying a 40-inch sign that read, "Jesus Loves You & Your Baby. Let Us Help You," and attempting to hand out pro-life literature.

A regular fixture at the clinic and an outspoken opponent of the “bubble law,” Hoye had challenged the constitutionality of the ordinance in a federal lawsuit pre-dating his arrest. He had become a top target for the clinic staff.

Hing dismissed one count of using “force, threat of force or physical obstruction” before the trial got under way, and the jury found Hoye not guilty on the other count. Instead, the jury returned guilty verdicts on two counts of “unlawful approach,” although there is some question about how sure jurors were they were making the correct decision. “The jury members came back to ask to watch the videos again and asked the judge to define what constituted an ‘approach,”’ said Hoye shortly after the verdicts were returned. “There is a clear definition given by the U.S. Supreme Court in a case related to a similar law, the law the Oakland law is based on, but he wouldn’t give it to them.”

The videos to which Hoye refers were recorded outside the abortion clinic on May 13 and presented as evidence by the defense during Hoye’s trial. The tapes showed that clinic employees approached Hoye, not the other way around.

Katie Short, an attorney with Life Legal Defense Foundation, told California Catholic Daily last month she was troubled by the interpretation of what constitutes an “approach” under the law. “The ordinance prohibits approaching within eight feet of someone entering an abortion clinic, without their consent, for the purpose of... let’s call it ‘communication,”’ Short explained. “The clinic director and escorts took this to mean that Walter could not approach them without their consent, even though they were not entering the facility and he was not trying to communicate with them.”

Hoye, who has no previous criminal record, rejected a plea bargain offered by the district attorney before trial. The deal guaranteed no jail time if Hoye pleaded guilty to one count in exchange for dismissal of the other three. “The threat of four years in jail is a potent one, but my client is more interested in getting the truth out, both on the sidewalk and in the courtroom,” commented Mike Millen, another Life Legal Defense Foundation attorney working on Hoye’s case, when the offer was turned down.

Rev. Hoye, a holy man, should be held up in honor in every Catholic Church. Where were the Catholic bishops on this day in court? And, who was the lonely Minister who confronted the morally corrupt judge? Recall that Hitler's Germany had many judges that reviewed complaints against the Jews, Catholics and others. The entire German legal system was reworked by Hitler to accommodate his terror regime. The fact that a "judge" and a "jury" gave a verdict here means nothing, except that this was an opportunity to express your faith. This is a frightening situation.

We are in the corner of a man in the image of St. Peter, who, when released from jail by an angel, where he was sent by the leadership for preaching the gospel of Christ, which was contrary to their opinions, leadership, went right back to the scene of his arrest to continue preach the gospel, teach us how to follow in the footsteps of Christ. You are exemplary to us Catholics, especially those in leadership positions, and you know who you are!

Once again I must call readers' attention to the fact that it would have taken just ONE juror, in the privacy of the jury room, voting "NOT GUILTY", and the Rev. Hoye could not have been convicted. This good man has stated he intends to go back to the abortuary to witness for life. He will no doubt be arrested again. Is there not ONE single Christian in all of Alameda County willing to vote to acquit at his next trial, no matter what the judge "instructs" the jurors to do?

Pray, pray, pray. There is nothing else we can do, except to challenge an unjust judicial system like the Reverend. "Judicial Blackmail", that is all I can say about his so-called "sentence". With the stay-away order in place all he has to do is show up and they can call and he will be arrested, again. It is not going to get any better, only worse, so, batten down the hatches, people, we are all in for a bumpy ride.

Looks like jury nullification does have a long and legitimate history. It came in real handy during the mid-19th century trials of those who harbored runaway slaves. Because of Christian jurors, it became impossible for the government to get a conviction. The Fugitive Slave Laws simply became unenforceable, and prosecutors eventually gave up. Prolifers can do the same thing with these unfair and arbitrary bubble laws.

I just can't help but feel sick to my stomach at our system sometimes. May God help Rev. Hoye. He is our hero in Christ. Obviously this court system in California wants to send out a message to all pro-lifers, they want to discourage pro-lifers with this unjust sentencing towards Hoye. However little do they know that we are not driven out so easily, we have the unborn who need us to hang in there for them.

I understand from someone at the courtroom today...... That there were not enough seats for the Pro- Rev Hoye people, more given to the against Rev. Hoye....not surprised!!! Also, the overcrowd were praying on their knees in the corridor and were then harassed by the against Rev. Hoye people..... How low can you go!!!!!!!! I also understand that he stood his ground (with the Holy Spirit's help, of course) and that he would not give into not being able to be outside the abortion mill..... and he won on that ! He is the most wonderful man and PLEASE everyone support him in prayers and financially to the legal defense, if you can!

Pastor Hoye is a modern-day Rev Martin Luther King Jr.. Prolifers like him are fighting the civil rights battle of today, fighting to be the voice of the unborn child, and to save the women from the heartbreak and physical complications of abortion. He knows that the African-American community has three times the abortion rate of the white community and that it is no accident that most Planned Parenthood mills are in the minority community. Margaret Sanger founded Planned Parenthood in the 20's with an openly racist agenda which people like Nancy Pelosi embrace today when they include contraceptive funding in the Stimulus Package. For them fewer minorities equals a better economy. Minorities need better education, not abortion!! Pastor Hoye is a hero!

I'm with you, St. Christopher. Where were the Catholic bishops on this day in court? I really feel bad about priests and bishops who tell me they have good reasons for not speaking up. I'd like to know what those reasons are. I told my pastor that I noticed some empty spaces on the bulletin board at the back of the church and asked him if I could put some Pro-Life items in those spaces. He said (and I quote) "I don't want to have anything to do with you."

Betty, Sounds like you are on the 'black list' as I am in my parish! I have been told by a reliable source that when it comes to having info tables regarding pro-life..... I am not to be at the table. Also, I asked to place some EWTN brochures in the vestibule and I was chastised by my Pastor...... .ONLY ONE ITEM, ONLY ONE ITEM as he was pointedt his finger at me like I was a 3 year old! And he's only a year younger than I...... I said to him, it's not the Playboy channel I'm trying to promote!!!!!!! We need to pray for all our Priests, especially the liberal ones, which seem to be plenty thereof.

Leticia, Margaret Sanger and some women politicians are white versions of the Hindu goddess Kali who is associated with death and distruction. Instead of helping black women live more fruitful, moral, family orientated lives they chose to help destroy their families. I remember when a young black teen was complaining to me about her father, who was a minister. She said that her father would not let her do this, and her father would not let her do that. I told her, "Listen to your father. He is only trying to keep you out of trouble. You are lucky to have a father. I never knew my father. My mother and father were devorced. I was raised by grandparents." Never-the-less, let us pray for a change of heart of all these women, and men too.

STOP the bill gates foundation and HP foundation, from the billions they donate to control the population(abortion) of the undesired. And, hundreds of other foundations sending donations to Mexico, THEY MUST REALY REALLY HATE US, to spend billions. Garvan, you do not give money to the Church. You return to God a portion of the gifts He has given you. The Church teaches that you should give of the "first fruits". For someone on Social Security that might be as little as $100 per month. For those who make a lot more, it would be a lot more. One good rule of thumb I heard one day was that we should commit to give back to God at least as we commit to give to an unknown banker for the loan on our car. Not giving a dime to the Church is vindictive and takes away from the ability to attract souls to Christ. It's not about you/me/us, but about thanking God for our gifts.

One can give money charitably elsewhere than to the collection plate. Tithing is not a commandment for the Church. St Paul explains this.
